a large ceremony here anniversary. a large crowd in attendance. many dignitaries as well as family members and employees at the pentagon. this year, however, there will be quite a different ceremony. there will be a remembrance ceremony at 9:30 this morning, but it will only be open to family members. a much smaller gathering than what we've seen in the past. the victims memorial is also closed to the general public, and they're doing this to allow families to reflect and mourn i the ceremony. now, there's a real effort to make this a very intimate and private event this year, and they are keeping the numbers down. that is why they are limiting the attendance to just family members. now, for those whoto honor those aro 9/11, you can do so later on after that remembrance ceremony takes place. they will be reopening the victims memorial right around noon after the ceremony ends. and then the general public can come here to the pentagon. but in terms of this morning, all events are open only to the

a man with a gun. >> this morning we are getting a new look at the deadly shooting at a sikh temple near milwaukee, wisconsin. police released dash cam video showing the gunman opening fire on the first officer who arrived on the scene. you can see one officer and the gunman run over to the officer who was shot 15 times. you can even hear the gunfire. the officer did survive. police say the gunman was a white supremacist who killed six people in that shooting. the gunman eventually took his own life. a marine is wanted for a vicious beating caught on camera. you see it here. g gunnery sergeant started pummeling a cab driver early sunday morning. he fractured his face. the driver says he was picking up another passenger to try to reduce his fare. he also threatened to kill the

driver. after the beating here, the marine checked himself into a nearby mental facility. police say they will arrest him as soon as he is released. this morning more than 25,000 teachers in chicago will once again stay out of the classroom and hit the picket line. leaving more than 400,000 students in a bind. the chicago teachers union and the school board still have not been able to agree on a new contract. there is an impasse concerning new reforms that link new teacher evaluations with standardized test results in exchange for a 16% pay raise over four years. the two sides also cannot agree on health benefits, pension and job serity. many parents just want the issue resolved to their kids can get back to school. >> education is important. and my child is not in school getting the education she needs, you know, what -- it's just -- it's just irritating right now.

>> several boys and girls clubs opened early for students. the union is taking a major stand on teacher evaluations. if they lose, it could have a ripple effect across the country. 17 after the hour. defense secretary leon panetta is defending the government's response to a book detailing the mission that killed osama bin laden. panetta says the book "no easy day" could set a dangerous precedent and jeopardize future top-secret missions. the pentagon says it's reviewing the book where a navy s.e.a.l. wrote to determine what classified information may be in it. the defense department says it may press charges against the > less than two months from election day, and the race remains neck and neck. president obama leads mitt romney by six points according to the latest "washington post"/abc news poll. that is just a single point among likely voters. voters are also sharply divided on how they believe president obama is doing. just 48% of them approve of his performance. 50% disapprove. the campaigns and groups supporting the candidates are spending hundreds of millions of dollars this election on ads.

in fact, they've spent more than $500 million since march. and most of that money is flowing into battleground states particularly florida, ohio and virginia. in fact, campaigns and groups have spent more than $300 million in those three states alone. that's more than half of the total spent. and apparently republicans are not embracing this florida pizza shop owner quite as much as he embraced president obama. big apple pizza has gotten negative reviews on yelp since its owner bear hugged the president. one claimed she felt compelled to disrespect the restaurant as much as the president disrespects our constitution. he's received plenty of positive responses. the owner is a registered republican. this morning actress miley cyrus is under investigation for assault. tmz reports an unidentified man filed a report claiming cyrus assaulted him at a hollywood hotel over the weekend. 919-year-old cyrus was with her fiance, liam hemsworth, when

they were talking to the victim. cyrus allegedly pushed him and hit him in the face. officers say the man did not have any visible injuries when he filed the report. police have not made an arrest. this morning the web-hosting site godaddy.com is back up and running. someone hacked the web host yesterday, taking down millions of internet sites it serves. an anonymous hacker is taking responsibility for the attack. the hacker says they picked on godaddy to test its cybersecurity. godaddy says it will provide more information on the cyber attack today. a florida tech company says it, not the fbi, is the source of a file taken by hackers last week that contains a million i.d. numbers for apple devices. blue toad which corrodes apps and mobile materials says it made the discovery after the hackers posted those numbers online. the hackers had claimed that they stole the file from an fbi agent's laptop. the i.d.s don't typically contain information. rather they correspond to a certain device. one of the high-end shopping events kicks off today.

this year's event is being held in friendship heights at filene's basement. the event will feature more than 20 local boutiques with discounts up to 90% off. we checked and there are still general admission and benefac r benefactors tickets still available between $40 and $250. the proceeds go to charity. 21 minutes after 5:00 on this tuesday morning. we're looking at temperatures right around 60 degrees outside our studios. a little cooler, though, if you are in the suburbs and beyond, right, tom? >> in fact, that's the warm spot. elsewhere, we are down into the 40s in much of the region this morning. we just saw there a live view from our nbc 4 hd camera. all these areas in blue are in the 40s including our northern suburbs and parts of northern virginia, but a big area of the shenandoah valley and into the mountains are into the 40s. some of these dark blue areas are in the 30s. some of the spots in the deeper valleys out in west virginia down into the upper 30s this morning.

healing here in the city. mayor bloomberg announced that they have reached a resolution over a financial dispute that had prevented them from finishing a museum here at the memorial. and construction will now resume on that and likely take about a year to be finished. it's something that many survivors and also family members of the victims have said is necessary to really make this tribute complete. and then also just announced yesterday, the world trade center health program will now provide treatment to many of the people who came down with cancer due to debris fallen in the attacks. two necessary steps toward healing for many people still struggling here in the city following these attacks. from lower manhattan, danielle leigh. this morning senior u.s. officials are confirming that the number two al qaeda leader in yemen has been killed. yemeni officials say this man was killed by a hellfire missile from a u.s. drone. five other militants were killed in the attack.

al shari was released in 2007. u.s. officials believe he was directly involved in the underwear bomber plot to blow up a u.s. plane in december 2009. you will likely see a heightened security presence today on metro. in montgomery county, police will be using a new safety tool as well. they're carrying devices that detect radiation. a hit causes lights to flash and a vibration or audio signal. the department recently bought 40 of these detectors with federal grant money. >> the type of radiation we're trying to detect is the type of radiation that would be seen as the ideal ingredient for a weapons of mass destruction, a dirty bomb. one of the ingredients that the terrorists would like to use. >> now, police say that there is no threat against metro. they're just being proactive. a police spokesman says during the few months they've used these devices, there has only been one alarm. today five men convicted of murder in one of the deadliest mass shootings in d.c. history will be sentenced.

carter, carter, best, bost and williams will learn their fates. the men carried out a series of violent crimes in march 2010 that culminated in the south capital street mass shooting which killed three and injured six. in all, the men killed five people and injured nine others in a series of a revenge attack that prosecutors say started over stolen costume jewelry. all five face life in prison. police officers now working with an fbi agent to help solve the murder of a 17-year-old high school student shot and killed in her own bedroom. last night police held a public meeting about the murder of amber stanley. they say her murder was not a random attack. last month a masked gunman kicked down the door at stanley's home in kettering. he went into her bedroom and opened fire, killing the teenager. amber's mother tells news 4 some people hated her daughter's success. >> no one deserves to die. definitely no one deserves to be murdered, shot the way my

daughter was shot. you know, for no apparent reason, you know. i don't know if someone is envious or jealous, got the wrong person, i don't know anything, you know. i would hope that no one would intend to shoot my daughter. >> police passed out flyers reminding people of the reward up to $25,000 for information leading to an arrest and indictment in this case. a 17-year-old boy shot in the cafeteria on the first day of school in baltimore is finally home. daniel baroi was shot last month. he left the hospital yesterday after spending two weeks there. the boy who has down syndrome suffered a bruised lung, fractured rib and a hole in his torso. the accused gunman, 15-year-old robert gladden, is charged as an adult with attempted murder and assault. it is now 5:36. making it harder to get around the district. where drivers can expect to run into some roadblocks. plus, why the policy at one sporting goods store will help you save a few pennies. another school start to your morning, but it's shaping up to be a day you'll want to spend

triathlon. >> reporter: i'm angie goff tracking breaking news outside a police station in turkey. just in, turkish television stations are reporting rumors of a suicide bomber as a cause of the blast that killed one and wounded several others early this morning. there is no confirmation on that. but this is a place where fighting between turkish forces and kurdish rebels have spiked recently. the explosion happened outside a police station close enough to cause damage to the building. this was in a suburb of the country's biggest city,

istanbul. a very populated residential area. no one has claimed responsibility for the blast. reporting live in the newsroom, angie goff. get ready for more gridlock downtown. d-dot begins work on a project to revamp new hampshire avenue from h street to dupont circle. our reporter live in northwest where construction will start, tony, in just a couple of hours. >> reporter: yeah, they're actually starting to set up construction now, aaron. you had it right, get ready. you can see they already have the tree protector set up. in the street they already have cones blocking off lanes, goes all the way down new hampshire avenue. as you said, it was part of the d-dot streetscape plan. they are putting in better lighting and tree enclosures, resurfacing streets as well as sidewalks. also storm drains will get an upgrade to include inlets and storm sewer pipes as well as the addition of a few fire hydrants. that's the good news. bad news, construction is expected to last around 18 months, weather permitting.

so if we have any severe inclement weather, we could be looking at almost two years for the project to be complete. and now construction will be taking place between 7:00 a.m. and 7:00 p.m. monday through friday. and occasionally weekends during overnight hours. as for traffic, good luck. for everyone using new hampshire avenue in this area, there will always be one lane open in both directions, but one very important thing to note, curbside parking will be restricted in some areas. so don't get your car towed. if you ride the metro or the bus, don't worry. all stations and stops will be open during construction. so make sure you are aware of the construction and plan, plan, plan for your commute because aaron, as you said, this is very heavily traveled. so there will be some very big delays. and one thing to mention, aaron, you said you turned your heat on this morning. you're not the only one. i did, too. it's a little chilly outside. live in northwest, tony tull, news 4. >> that's a good-looking jacket. thank you, tony.

the naacp wants laurel's police department investigated. it's video from this cell phone that appears to show an officer slapping or punching a man in handcuffs last month. leaders with the prince george's county chapter of the naacp say it shows possible police brutality, and they want the justice department to step in. they also want a federal probe into what they call racial profiling and discrimination in hiring. the officer in that video is currently on administrative duty. a jury found a teen guilty of killing a catholic university graduate student. that jury convicted eric foreman of first-degree premeditated murder in the death of the man. the man was gunned down while riding his bike in sherman circle in 2010. foreman was 16 at the time. he could face life in prison without parole. sentencing is set for november 16th. robbery does not appear to be the motive behind a shooting inside a rite-aid in northeast. police are asking for your help to find the gunman. sid yoe shows the man entering the store around 9:30 sunday night.

police say he covered his face with a surgical mask and shot an employee. the victim is expected to be okay. in april, surveillance cameras at the same store captured a different gunman shooting the manager in a robbery, paralyzing him from the waist down. the suspect was arrested in that case. american express is going after gary giordano. it's suing the montgomery county man who was suspected in the death of his travel companion, robyn gardner, in aruba. amex wants to void the travel insurance policy giordano took out in gardner's name before their vacation last year. the company claims that policy is not legal because the two were not married, related or business partners. giordano insists gardner was swept out to sea while they were snorkeling. police in aruba eventually released him from jail because of a lack of evidence. a judge ordered the release of a figure skateding coach in laurel accused of fondling a teenage student. the 50-year-old competed in the 1988 olympics. he must now turn himself in to new york state police within 72 hours and give up his passport.

he's accused of kissing and fondling a student at a competition in lake placid last year. he denies those allegations. this morning a family is mourning the loss of a 2-year-old boy who apparently drowned in a backyard pool. chopper 4 flew over the scene yesterday morning in the 17000 block of sandy knoll drive. police say a neighbor was performing cpr on the child when they arrived. the boy was two months short of his third birthday. he was at home with a caretaker at the time. police are trying to figure out how the child got into the pool. a former aide to d.c. mayor vincent gray likely will not serve jail time because prosecutors say he's been helpful in their corruption investigation. prosecutors said in court documents that howard brooks has provided, quote, substantial assistance and that probation and community service would be a suitable sentence. brooks pleaded guilty in may to lying to the fbi about making payments to fringe candidate

suleiman brown, one of three former gray aides to plead guilty. he'll be sentenced october 10th. sentencing for kwame brown has been delayed. brown pleaded guilty to bank fraud and a misdemeanor campaign finance violation in june. he admitted to lying about his income on bank loan applications. the judge moved back the sentencing to november 12th to give him more time to cooperate with prosecutors. he faces a maximum sentence of six months in prison for each charge. montgomery county says pepco does not have enough crews to keep up with the frequent power outages. according to "the washington examiner," that's what the county's office of consumer protection said in a filing with the maryland public service commission. the filing criticizes pepco's performance after june's derecho. sayi9do$1 took the utie than a week to restore power to all of the more than 450,000 customers who lost electricity. loudon county health officials say they are against ground spraying for ticks around playgrounds and athletic fields. the lyme disease commission asked the county to spray around
